Enforcement discipline

How a forum is assessed.

Every matter is assessed for enforceability before it is considered on its commercial merits. That assessment reflects the credibility of the forum, the traceability of the defendant's assets, and the recognition regime available at the point of collection. A favourable judgment that cannot be collected is not treated as a recovery.

A favourable judgment in an unenforceable jurisdiction is a loss. That single proposition disposes of more inbound matters than any other element of our diligence.
