How an Enquiry Proceeds

Preliminary enquiry, then any clarification the affiliate requires in writing, then an internal decision whether to progress, then the applicable confidentiality process, and only then an invitation to formal intake. Information Barrier

Hudson Litigation Defense Capital is a separate legal entity with its own capital, its own committee and its own records. An enquiry lodged here is reviewed by officers of the affiliate only and is not visible in Hudson Litigation Capital's ordinary deal flow.

What the Affiliate Finances

The costs of prosecuting an affirmative monetary counterclaim held by a corporate defendant, on a non-recourse basis, payable from defined proceeds of the counterclaim. There is no upfront fee, and nothing is payable at enquiry.

What It Does Not Finance

The cost of defending the underlying claim, a defensive set-off presented as a counterclaim, and matters outside the published mandate or in jurisdictions where the financing is not permissible.

Confidentiality in Plain Language

Enquiries are treated as confidential and are segregated on receipt behind the information barrier. The affiliate does not represent that its confidentiality arrangements confer privilege, that common-interest protection arises automatically, or that its involvement will never be disclosed. Confidentiality is subject to applicable law and to court and tribunal rules, orders and disclosure obligations.
