Transaction context
How capital is used in this family.
Capital to a qualified purchaser, or to a dedicated acquisition vehicle, acquiring a commercial claim or a legally transferable economic interest in one.
Capital advanced against an existing judgment or arbitral award, so that the holder obtains liquidity before collection while retaining an agreed residual economic interest in the eventual recovery.
Where the holder prefers a clean exit rather than an advance, Hudson may acquire a judgment, an arbitral award or a legally transferable economic interest in one, in whole or in part.
Capital for the work of turning a judgment, award or established entitlement into money: recognition proceedings, asset tracing, freezing and disclosure applications, insolvency-based routes and enforcement across jurisdictions.
Where capital may be applied
- The acquisition consideration, or capital secured on the acquired claim and its proceeds.
- An advance against the expected net proceeds of the judgment or award.
- Acquisition of the whole judgment or award, where transferable.
- Recognition and enforcement proceedings in relevant jurisdictions.
- The costs of prosecuting estate or creditor claims.
- The costs of prosecuting the acquired claim after acquisition, where included in the approved commitment.
- Continuing enforcement and recognition work, where included in the approved commitment.
- Acquisition of a partial economic interest, leaving a residual with the seller.
In each case as set out in the approved commitment and the transaction documents.
Relevant considerations
What Hudson examines.
Published considerations only. Internal underwriting methodology, pricing and return parameters are not published.
- 01Whether the asserted right is capable of transfer under the applicable law and the governing documents.
- 02Finality: whether appeal, annulment or set-aside routes remain open.
- 03Transferability under the applicable law and any anti-assignment restriction.
- 04What assets can actually be identified, reached and realised, and where they sit.
- 05The officeholder's authority, and whether court approval is required or obtained.
- 06Ownership, chain of title and whether ownership is disputed.
- 07Recognition and enforceability in each relevant jurisdiction.
- 08Chain of title and the authority of the seller to transfer.
Counterparties
Who this family is for.
- 01Qualified acquirers of commercial claims and legal economic interests.
- 02Judgment and award creditors facing a long or contested collection.
- 03Judgment and award creditors seeking certainty of value now instead of an uncertain recovery later.
- 04Authorised insolvency officeholders, administrators, liquidators, trustees and receivers.
- 05Holders of a claim who wish to sell or monetise it and need an institutional counterparty on the other side.
- 06Corporates carrying a favourable result that has not converted into cash.
Independence and published limits
Hudson gives no view on whether a particular claim is legally assignable until its General Counsel has completed the applicable review. Nothing on this website is an offer to purchase any claim. If a proposed acquisition advances beyond preliminary assessment, any transaction-specific structuring fee or other commercial terms will be disclosed in writing before an applicant incurs that obligation.
No capital band is published for the solutions in this family; those parameters are transaction-specific. Certain matters outside an applicable published band may be considered by exception.
