Post-Outcome Capital

Liquidity and capital after a favourable outcome and before payment.

Once liability is resolved or a settlement is documented, the analysis changes: finality, obligor quality, enforceability and time to cash matter more than the merits that produced the result.

§ 2

Transaction context

How capital is used in this family.

Capital advanced against an executed settlement that has not yet been paid, so that the recipient obtains liquidity during the payment period.

Capital for the appellate and post-trial phase where a favourable first-instance outcome has been obtained and is under challenge, or where post-trial steps must be funded before the result converts into money.

The analysis is a credit and documentation analysis rather than a merits analysis: liability has already been resolved.

Appeal Finance is a distinct product. It is not the same as monetising a judgment, which sits under Claims & Recovery.

Where capital may be applied

  • An advance against the net settlement receivable.
  • Appellate counsel fees and disbursements.
  • Related collection work where payment is not made as agreed.
  • Post-trial applications, security and procedural costs.
  • Recognition and enforcement steps taken alongside the appeal, where approved.

In each case as set out in the approved commitment and the transaction documents.

§ 3
